1. General
These Terms of Use govern access to and use of the DOSTO24.GR website (hereinafter referred to as the “Platform”).
By accessing, registering with, or using the Platform, the user declares that they have read, understood, and accepted these Terms of Use. If the user does not agree with any of these terms, they must not use the Platform.
The purpose of the Platform is to provide an online space through which users can publish listings, offer products for sale, and communicate with other users interested in purchasing them.
2. Registration and User Accounts
The creation of an account may be required in order to use certain services.
The user is required to provide accurate, truthful, and up-to-date information and is solely responsible for maintaining the confidentiality of their account login credentials.
Users are not permitted to use another person's account without their permission or to create accounts using false or misleading information.
The user is responsible for all activities carried out through their account and must immediately notify the Platform if they become aware of any unauthorized use.
3. Publishing Listings
Users may publish listings for second-hand or other permitted products in accordance with the categories and rules of the Platform.
The seller is solely responsible for the accuracy and completeness of the information contained in their listing, including the description, condition, price, photographs, and any characteristics of the product.
Photographs must depict the actual product or clearly represent the item being advertised.
Misleading descriptions, false information, or the concealment of material defects or characteristics that could affect a buyer's decision are not permitted.
4. Prohibited Products and Content
The publication of listings or content that violates applicable Greek or European Union law is prohibited.
This includes, but is not limited to, illegal products, stolen goods, counterfeit goods that infringe intellectual property rights, illegal substances, or other items whose sale or possession is prohibited or restricted by law.
The Platform reserves the right to remove listings or content that it considers to be in violation of these Terms or applicable law.
5. Transactions Between Users
Unless expressly stated otherwise, the Platform operates as a means of displaying listings and facilitating communication between users and is not the seller of products listed by third-party users.
The contract of sale is concluded between the seller and the buyer.
The seller is responsible for the ownership, legality, condition, quality, and delivery of the product, while the buyer is responsible for assessing the listing and the product before completing the transaction.
Users are responsible for agreeing between themselves on the price, payment method, delivery or shipping arrangements, and any other terms of the transaction.
6. Second-Hand Products
Users acknowledge that products offered through the Platform may be second-hand and may therefore show wear, signs of use, or other differences compared with a new product.
The seller must accurately describe the actual condition of the product and disclose any known material defects or damage.
The buyer must carefully review the description and photographs and, where necessary, request additional information from the seller before proceeding with the purchase.
7. Professional and Private Sellers
Both private individuals and professional sellers may operate on the Platform.
Where a seller acts in the course of a professional or commercial activity, they must comply with all obligations arising under applicable consumer protection, e-commerce, taxation, and other relevant legislation.
The rights granted to consumers by law in relation to professional sellers are not limited by these Terms.
Transactions between two private individuals may not be subject to the same consumer protection rights that apply to transactions between a professional seller and a consumer.
8. Prices and Payments
Product prices are determined by the respective sellers unless otherwise stated.
If the Platform provides electronic payment services, the applicable terms, any fees, and available payment methods will be displayed during the transaction process.
The Platform is not responsible for payments made directly between users outside any official payment mechanisms that the Platform may provide.
9. Shipping and Delivery
Where shipping or delivery is arranged directly between the seller and the buyer, both parties are responsible for agreeing on the method, cost, and delivery time.
The Platform is not responsible for loss, delay, or damage during transportation where transportation is arranged independently by the users.
10. Returns and Disputes Between Users
For transactions between private individuals, return or cancellation terms are agreed between the buyer and seller, subject to any rights that may be provided under applicable law.
Where the seller is a professional and the buyer is a consumer, the rights and obligations provided under consumer protection legislation shall apply.
The Platform may, without being obliged to do so, provide communication or support mechanisms to facilitate the resolution of disputes between users.
11. User Obligations
Users must use the Platform lawfully and in good faith.
Among other things, users are prohibited from using the Platform for fraud, deception, harassment, sending unsolicited messages, collecting personal data without a lawful basis, infringing the rights of third parties, or attempting to gain unauthorized access to the Platform's systems.
12. Ratings and Reviews
Where a rating or review system is provided, users must publish reviews based on genuine experiences and transactions.
False, misleading, coercive, offensive, or abusive reviews are not permitted.
The Platform reserves the right to remove reviews that violate these Terms.
13. User Content
Users retain their rights to the content they create and publish, to the extent that such rights belong to them.
By publishing photographs, descriptions, and other content on the Platform, the user grants the Platform the necessary permission to use, store, technically process, and display such content for the purposes of operating and promoting the service.
The user declares that they have the necessary rights to the content they publish.
14. Limitation of Liability
The Platform makes reasonable efforts to ensure the secure and smooth operation of the service but does not guarantee that its operation will always be uninterrupted or free from technical problems.
To the extent permitted by applicable law, the Platform is not responsible for the accuracy of third-party listings, the quality or condition of products, the financial or other conduct of users, or the fulfilment of agreements concluded directly between users.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by law.
15. Fraud and Transaction Security
Users should exercise particular caution when conducting transactions.
Users are advised to avoid payments or transactions where there are indications of fraud, unusual payment requests, or requests to disclose passwords, card details, or other sensitive information.
Suspicious listings or conduct may be reported to the Platform through the available reporting or communication mechanisms.
16. Suspension and Termination of Accounts
The Platform reserves the right to restrict, suspend, or terminate a user's access where there are reasonable indications of a violation of these Terms, misuse of the service, fraud, illegal activity, or a risk to other users or the Platform.
Where required by applicable law, the user will be informed of the decision and of the available means of challenging it.
17. Personal Data
Personal data is processed in accordance with applicable data protection legislation and the Platform's Privacy Policy.
The use of cookies and similar technologies is described in the relevant Cookie Policy, where such a policy is provided.
18. Intellectual Property Rights
The Platform's software, design, trademarks, logos, and original content are protected by applicable intellectual and industrial property laws.
Their copying, reproduction, modification, or commercial exploitation is not permitted without the prior authorization of the respective rights holder.
19. Amendments to the Terms
The Platform may amend these Terms where necessary due to changes to its services, applicable legislation, or the manner in which the Platform operates.
The version currently in force will be published on the website together with the date of the latest update.
Where required, registered users will be informed of material changes.
20. Governing Law
These Terms are governed by Greek law and applicable European Union law.
Any disputes should initially be resolved amicably where possible. Any dispute shall be subject to the rules governing jurisdiction established by applicable law, including consumer protection provisions where applicable.
